KHRC Call for Expression of Interest for Consultancy Services for a Research on Women’s Labour Rights


The Kenya Human Rights Commission (KHRC) is a national NGO with the mission to promote, protect and enhance the enjoyment of all human rights by all individuals and groups.

The KHRC intends to award a consultancy to a highly competent, qualified and experienced research consultant or firm having the relevant technical background, to conduct a research on women’s labour rights.

Purpose of the consultancy:

In line with the KHRC’s goal of the year (2011- 2012) “investing in the new constitution for accountability and Justice”, KHRC towards improving access to economic, social and cultural rights intends to carry out a study on women’s labour rights, who make a majority of labour force within the horticulture industry.

The research targets an in-depth understanding of rights situations and experiences of workers as regards equality between male and female workers on

a) equal pay for equal work,

b) maternity and paternity leave

c) child support,

d) sexual harassment,

e) dismissal, and

f) casual labour and contracts.

The research also aims to consider companies human resource policies and their implementation in relation to compliance with the Employment Act and rights entrenched in the Constitution, as well as interplay between legislations, policy and practice.

The study locations will be Naivasha, Thika and Athi River.

The research recommendations and follow up advocacy will contribute towards improving workers livelihoods (income) / standard of living (social and cultural rights) through increased understanding of the Employment Act (2007), Constitutional provisions on equality and non-discrimination and women’s labour rights violations by the public, women workers and employers.

This will consequently influence market demand for products that adhere to high standards with regards to workers rights.

Specifically, the study will;
  1. Explore the legal and organisational policy provisions for women’s rights as workers.
  2. Assess levels of understanding by women workers of their labour rights as provided for in the Employment Act 2007, Constitution of Kenya (2010) and organisational policies.
  3. Examine the situation of women workers / their practical realities and the extent of respect for their rights
  4. Establish in what ways there is alignment of or a mismatch between legislation, organizational policy and reality.
  5. Consider measures adopted by the employers towards improving employment practices– have these reform agendas improve access to economic and social rights and service delivery for women workers
  6. Identify any model companies with regards to compliance with outlined women labour rights observance; to profile as a learning point by other companies
  7. Provide recommendations on necessary actions by workers and employers to improve women’s rights as workers
Primary Tasks:

Towards delivery of the assignment, the successful consultant will be expected to
  1. Attend meetings with KHRC team to discuss and map out key issues and targeted areas for the assignment by 27th Sept
  2. Carry out desk review of legal instruments, policy papers, reports and other publications in line with the study;
  3. Develop and present research tools, methodology for the study and the preliminary desk review report to KHRC and a select team of stakeholders for comments and approval by 12th October 2011;
  4. Conduct field based interviews in the 3 focus areas as per the agreed sampling design and methodology by 30th October 2011
  5. Analyze and interpret the findings;
  6. Share the report with a select team (KHRC and some key stakeholders) for validation and final inputs by 14th November 2011
  7. Submit the final report with clear research findings and relevant policy recommendations by 25th November 2011
The consultant is required to possess
  1. Professional experience in conducting research (data collection & analysis) and reporting – both qualitative and quantitative
  2. Good analytical skills
  3. Demonstrable experience in assignments of similar nature, including understanding of workers and livelihood issues; and relevant regulatory frameworks
  4. Excellent documentation and writing skills, attested by past written papers.
  5. A relevant degree in social science discipline
  6. Ability to interact effectively with local communities and as part of a technical team.
  7. Availability to meet project deadlines.

KHRC invites interested consultants (individuals / firms) with experience in executing similar assignments to submit their expression of interest accompanied by a detailed profile, stating their capability, availability, a detailed work‐plan, expected consultancy fee for this assignment and contacts of three referees.

Kenya Utalii College Corporate Rebranding Expression of Interest


Statement of Purpose

Kenya Utalii College (KUC) is the premier training institution for the Hospitality and Tourism industry.

The College intends to undertake a re-branding exercise which will entail the development, implementation and evaluation of the Kenya Utalii College brand.

The rebranding process should include a culture change programme for the internal stakeholders, so as to, enhance the overall experience for our customers and external stakeholders.

Therefore, the rebranding exercise should be designed to positively position Kenya Utalii College both in the present and future, within Kenya and the African region.

Background

Kenya Utalii College (KUC) was founded 36 years ago, with an aim of developing a highly qualified human resource base for the Hospitality and Tourism industry.

The institution has over the years played a significant role with regard to training personnel for this crucial industry.

Since inception, the College has trained approximately 45, 500 graduates from over 20 countries, in different disciplines including: Food Production, Housekeeping and Laundry, Hotel Management, Front Office, Tour Operations and Tour Guiding in the Hospitality and Tourism arena.

Scope of Work

The services will include but not limited to undertaking a mapping exercise to establish current practices of different training institutions in the sector within Kenya and best practices from developing and developed countries, evaluating the needs of the College, development and implementation of a new corporate identity, comprehensive brand manual, development of effective internal and communications strategies, tools and materials, internal culture and attitude change, capacity building within the institution for the long term sustainability of the brand.

In addition, the services will include developing a road map of the strategy programme; and address any other issue(s) incidental or related thereto.

The Consultant

Interested consultants are invited to provide their proposals in providing the services.

Conditions for Eligibility
  • Rebranding specialists - Proof of capability and experience in carrying out successful rebranding projects, at least three similar or comparable projects, within the last five years (Indicate name, contacts and location).
  • Proven analytical tools to track and measure progress of the rebranding exercise.
  • Evidence of Company registration.
  • Evidence of VAT registration and remittance.
  • Valid tax clearance certificate.
  • Evidence of financial capacity.
  • Company profile (company history, contacts, services, affiliation etc).
As part of the evaluation process, suitable firm(s) will be shortlisted on the basis of the written EOI submitted to KUC, and may be invited to make presentations.

Improvement of Terms of Reference (TORs)

The consultant may offer suggestions and improvements in the TORs, which they consider would result in better implementation of the project.

Following evaluation of the Expression of Interest, shortlisted tenderers will be invited to participate in a formal tender in which they will be required to submit detailed technical and financial proposals in a format to be provided.

Completed EOI documents in plain sealed envelopes, clearly indicating the tender number and name as indicated above should be placed in the Tender Box at the College Reception not later than 10.00 am on the closing date Wednesday 17th August 2011.

Energy Efficiency Audits in Kenyan Government Buildings and Institutions


Expression of Interest for Energy Efficiency Audits in Government Buildings and Institutions

The Ministry of Energy is encouraging the use of renewable energy and also energy efficiency and conservation. It has been realized that there are immense benefits to be realized, by promoting efficient utilization of energy. Since 2006, the Ministry of Energy has been supporting the Kenya Association of Manufactures (KAM) with funds to undertake energy efficiency audits, mainly targeting the industrial sector.

It has been established that there exists potential to save upto 30 % energy consumption, translating to huge savings, which go a long way in lowering the energy costs. Other benefits include reduction in peak power demand. A rapid pilot study done by the Ministry of Energy has indicated potential in energy saving in government buildings.

The ministry now wishes to facilitate energy efficiency audits in selected government buildings and institutions, a sector which has not been fully covered under the programme with KAM. The main objective of conducting the audit is to assist selected buildings and institutions identify energy saving and energy efficiency measures resulting in demonstratable economic and environmental benefits.

These will be documented and disseminated to public institutions

The study will be conducted within a period of not more than Six (6) months.

Brief Outline of the Terms of Reference

The study will be conducted according to the following TOR:

Identify and Document energy saving opportunities, potential cost savings and advise institutions on modern technologies in energy efficiency;
Document Environmental benefits in terms of green house gas emissions reduction
Prepare a detailed technical report on the results of the energy efficiency audit of each site, which should include inter alia recommended measures, schedule of works with technical specifications of equipments, estimated costs, and financial and economic analysis of the investments.
Eligible firms are requested to express their interest in providing the above mentioned services.

Interested firms must submit the following information:

Copies of Certificate of Incorporation or Registration
Copies of PIN, VAT registration, Tax Compliance Certificate
Experience of the firm to undertake works of similar nature.
Capability of key personnel-their qualifications and competence in undertaking the audits
A brief outline of the technical approach and methodology for carrying out the audit.
