APSEA Independent Legal Consultant Job in Kenya


Enactment of the “Draft Bill on Natural Resource Development and Management, 2013” into Law
Background and Context:
The Association of Professional Societies in East Africa (APSEA) is the umbrella body of professional associations and societies in Kenya, with a corporate membership of thirty (30) professional associations from diverse professional disciplines. The corporate member associations have a total membership of nearly 50,000 individual professionals in Kenya alone. Professionalism is embedded within the Constitution of Kenya and as such, as the umbrella body of all professionals in Kenya, APSEA has a stake in the implementation of the constitution.
APSEA having realized the urgent need to address the issue of equitable distribution and management of resources in the country, especially with resources that are being discovered, such as oil in Turkana, the policy would be the best guideline to outline how the resources should not only benefit the whole nation but also provide benefits to the community where the resources are discovered.
APSEA is cognizant of the need to address Natural Resources Management (NRM) issues in the country highly.

Currently, APSEA through the NRM Technical team has just concluded the development of a Concept note, a Policy and Draft Bill on the Natural Resource Development and Management, 2013.

With this, APSEA will be lobbying Parliament, the Executive and other stakeholders with the aim of passing the NRM bill and enacting it into law. This legislation will address the distribution and management of resources, which will address the challenges at the counties when dealing with resource sharing.The constitution of Kenya, Article, 61 (1) states that all land belongs to the people of Kenya collectively as a nation, as communities and as individuals.

Goal of the Project

The goal of the project is to have the draft Natural Resource Development and  Management Bill enacted into Law. The Law will guide the sharing of revenue from the Natural Resources within the Devolved system of Government.Expected Consultants Outputs: It is with this in mind that APSEA wants to engage an Independent Legal Consultant with a bias in Natural Resource Management to carry out the following responsibilities under the proper guidance of the APSEA technical team:To engage Parliament, the Executive, Land Commission and other relevant stakeholders on the Overarching Policy and Draft Bill on the Natural Resources Development and Management, 2013.To capture the input of the stakeholders and input in the policy and draft bill that will be enacted into Law that engages the County government in the natural Resources equitable entitlement and apportionment in responsive to the needs and aspirations of the citizens of this Country.Prepare Reports and make presentations on project, Review the existing Overarching NRM concept, policy and bill through a consultative process involving APSEA Executive, APSEA NRM Committee, key and relevant GoK stakeholders, CSOs, parliament and private sector.Provide the requisite technical guidance to facilitate stakeholders decision making as pertains the domicile of the anticipated Overarching NRM policy & bill.Align the policy and bill with the CoK and other legislations.Support the APSEA Chair and NRM team in championing the policy & bill at different stakeholder levels; with the goal of building buy-in.Participate in developing strategies that would be applied in advocating and lobbying various government organs to adopt and support the eventual enactment of the bill.Deliverables and other provisions

 The dietitian will be responsible for assessing clients’ nutritional needs, diet restrictions & current health plans to develop and implement dietary-care plans & provide nutritional counselling.S/he will confer with doctors and other health care professionals in order to determine nutritional needs & diet restrictions of patient or client. S/he is also expected to advice patients & their families on nutritional principles, dietary plans & diet modifications, & food selection & preparation. The dietitian will also be involved in counseling of individuals and groups on nutritional practices designed to prevent diseases and promote good health within and outside the hospital in conjunction with the catering manager. The incumbent will also participate in recipe development & develop new menus for independent food service operations and also inspect meals served for conformance to prescribed diets and standards of palatability & appearance.
Qualifications & Requirements:Degree in Food Nutrition & DieteticsMinimum of two years relevant working experience preferably in a hospital Excellent Public Relations and Communication skills Applications should be received not later than 20th July 2013.
 The pharmacist will be responsible for checking prescriptions to ensure that there are no errors, dispensing medications by compounding, packaging, and labeling pharmaceuticals and ensuring that they are appropriate and safe for the individual patient and providing advice on the dosage of medicines. S/he will participate in ward rounds, taking patient drug histories and be involved in making decisions on appropriate treatments which will also involve discussing treatments with patients’ relatives.
S/he will be required to ensure that all medicines are stored appropriately and securely. The pharmacist may also be required to assist in writing guidelines for drug use within the hospital and implementing hospital regulations. The incumbent will be expected to develop the hospital staff’s pharmacological knowledge by participating in mentoring & training programs.

HelpAge Project Consultant to Support the Operational Research Component of the Project Job in Kenya


Terms of Reference, for a Consultant to support the Operational Research Component of the Project: ‘Strengthening Social Protection to prevent and mitigate the impact of HIV and AIDS and poverty in sub-Saharan Africa’

HelpAge International East, West and Central Africa regional office based in Nairobi Kenya, with funding support from Sweden / Norad, seeks a consultant to support the project’s research component under the study topic: Effects of regional and national (Public) policies on vulnerable populations in Eastern and Southern Africa.  

The study will cover Sweden/Norad funded project sites in Kenya, Uganda, Ethiopia, Tanzania, South Africa and Zambia.

Project Background

In 2011, HelpAge received funding from Sweden/Norad to implement a three year project, running from 2011- 2013. 

The goal of the project is to contribute to universal  access to HIV and AIDS services and Social Protection (SP) mechanisms for vulnerable groups in Sub-Saharan Africa by 2013.
 

The project has four result areas:Universal access to  HIV and AIDS services and Social Protection Mechanisms for Vulnerable groups is increasedRegional and National level HIV&AIDS  and SP policies and related [policies] plans and budgets increasingly incorporate measures which address the needs of vulnerable groups.Increased participation of Civil Society organisations in the formulation,  implementation and monitoring of National and Regional HIV and AIDS and Social Protection policies and strategiesEvidence on effective action contributing to the achievement of universal  HIV&AIDS and SP services gathered, documented and shared and acted on among CSOs, Governments and other stake holdersConsultancy Objectives and Scope of Work
This study will generate evidence on the learning and contribute to the project result areas above.  The study seeks to establish the benefits and changes in the lives of vulnerable populations attributable to policy formulation and policy implementation.  The consultant will therefore endeavour to provide evidence/information on the following areas:

a) How policies are formulated in Eastern and Southern Africa/How are the intended beneficiaries involved in Policy formulation?

b) Does enactment of relevant policies translate into improved services for the intended target group?
c) Are policies in Eastern and Southern Africa supported with implementation benchmarks and how and who is involved in policy monitoring?
d) Are policies in Eastern and southern Africa supported by pre-requisite resources and  support structures
e) What has changed as a result of the enactment of these policies in respective project site countries on the intended target groups?

The consultant is required to:

a) Work with HelpAge staff to review and improve on the research question and research design
b) Conduct literature review from HelpAge programme database and other relevant sources
c) Conduct key informant interviews with key resource persons to fill in the gaps in the literature review.
d) Analyse data and write a report

Deliverables

Research study report validated by stakeholders and approved for implementation

Education and Experience:

a) Postgraduate with extensive experience in policy research in Eastern and Southern Africa.
b) Strong knowledge on rights based approaches to programming

Expression of interest

All interested consultants/firms are requested to write an expression of interest by:
a) Explaining their competences to meet the requirements of the assignment
b) Provide a detailed professional budget in USD (Indicate daily professional rates)
c) Provide duration of the assignment and when ready to undertake the assignment.
d) Provide evidence of similar work undertaken in the recent past (Not more than 3 years)
Tax Liability: Settlement of any tax liability arising from this agreement will remain the responsibility of the consultant. The fees will be liable to withholding tax to be remitted to the Kenya government and a receipt will be availed to the consultant

With the aim to support EAC’s vision, mission, values and strategic goals the EAC Secretariat has developed a Communication Policy & Strategy. 

One of the main objectives is to enhance the brand image of the EAC and to reinforce the internal and external communications efforts. As a means of achieving this, the EAC Corporate Communications Department and GIZ have embarked jointly to take a holistic approach to develop a Design Guide by carrying out an entire branding project. We are therefore looking for a consultant (s) to plan and execute such a project.
The Consultant (s) should have:At least a masters degree in Communications, International Marketing or a related field from a recognised university/institution.Minimum 15 years work experience in strategic communications and corporate branding both on a strategic and an operational level.A solid experience working with employer branding in large organisations.Experience in carrying out a whole branding project from planning and execution to implementation in a corporate/public or intergovernmental entity is a MUST.Strong project management skills, with the ability to execute in a structured manner.Excellent communication and presentation skills.Experience working with the survey tool SurveyMonkey is an added advantage.The estimated duration of the assignment is a maximum of 180 working days starting from July 2013 to December 2014. The assignment requires the consultant(s) to be on-site at the EAC Headquarters in Arusha, Tanzania in regular and frequent intervals.
The EAC-GIZ program is asking interested consultants to submit a short (5 pages maximum) technical proposal as well as a separate financial proposal. Interested consultant(s) must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff, etc.). Experts may constitute joint-ventures to enhance their chances of qualification.
The proposal should also indicate the qualifications and their ability to undertake the project within the time frame identified.
Eligibility criteria, establishment of the short-list and the selection procedure shall be in accordance with GIZ Procurement Rules and Procedures.

The National Land Commission (NLC) is an independent Commission established by The National Land Commission Act No. 5 of 2012 pursuant to Article 67 of the Constitution of Kenya, 2010.
NLC has prioritized communications a key strategy and seeks to contribute to effective and responsive communication to enable the Commission to realize its objectives.
The Communication Consultant will work closely with the NLC to develop a communication Strategy for the Commission and oversee its implementation for a duration not exceeding 3 months. The Consultant will undertake the following:
 a) Design, coordinate, implement and monitor the communication strategy including a concept and an action plan and visibility plan.

Background

Kenya’s geographic location makes it inherently prone to cyclical droughts and floods. Moreover, according to the Initial National Communication (INC), such types of cyclical climate-driven events will increase in intensity and frequency due to global climate change. Livelihoods and economic activities in Kenya are highly vulnerable to climatic fluctuations, with the districts of the Arid and Semi-Arid Lands (ASALs) being among the most vulnerable to recurrent droughts, and to long-term climate change. The rural poor are the most vulnerable to the impacts of Kenya’s current climate variability.
In response to this, Kenya Government through the Ministry of State for Development of Northern Kenya and Other Arid Lands received funding from GEF in 2009 to support the Kenya Adaptation to Climate change in Arid Lands (KACCAL) project. The 3-year USD 1.0m fund is managed through UNDP and has from 2011 been supporting poor and vulnerable communities in the Arid and Semi-Arid Lands (ASALs) of Mwingi district to enhance their adaptive capacity to drought and flood.
The thrust of the project has been on livelihood diversification and livelihood enhancement interventions.
 (i) Viable Sustainable Business Models Developed for initiatives in each community.
(ii) Organizational structures in each community that will enable successful implementation of the business models Proposed

Background

The Danish Refugee Council (DRC) has been providing relief and development services in the Horn of Africa since 1997. Using a protection of human rights framework, DRC has mainly focused on Somalis who are displaced by conflict. Programmes include protection, livelihoods, food and NFI distribution, water and sanitation, and advocacy amongst others. 

The Regional Office (RO) is based in Nairobi, Kenya and there are four country offices and operations in Somalia, Kenya, Ethiopia and Yemen. Currently there are over 500 DRC staff in the region. The last two years have seen significant growth in programme size and a growth in the number of support and management functions demanded and required by the programme offices in order to maintain quality and accountability.

Given this context and the associated challenges, the RO management plans to undertake a comprehensive review of the Logistics and Procurement functions at the RO and a selected field office (Mogadishu).

Purpose
The main objective is to carry out an assessment of the DRC Supply Chain Management (SCM) capacity and effectiveness in service delivery to both beneficiaries and internal customers. 

The expected outcome is to implement sustainable systems that will enable DRC improve quality and accountability in its humanitarian work.

Key Responsibilities

A general assessment will be carried out on the DRC SCM business processes, procedures, structures, capacity and constraints that impact on quality service delivery.

Scope of Work

The review will attempt to cover the following:

Procurement and sourcing processes: review the procurement cycle, procurement planning, procurement tracking, procurement documentation, and provide recommendations of areas for improvementConduct the prequalification of preferred suppliers and service providers in Nairobi and Mogadishu. Institutionalize a formal Tender Committee with clearly defined roles. Review service contracts of current service providers (office supplies, taxi, transporters, fuel, vehicle service, etc.) Inventory management systems Vehicle fleet management including taxi utilization Logistics infrastructure: review all aspects of warehousing, distribution and tracking of supplies. Organizational structural processes and the necessary operating environment enabling strategic coordination of the supply chain.Supply Chain Department: review the structure of the Logistics and Procurement department including review of job descriptions and required skills and competencies. Lead the recruitment of staff in Nairobi.The above reviews must be done in line with DRC policies (Operations Handbook) and main donor regulations (EU, ECHO, DFID, OFDA), and will include reviewing and updating as necessary policies and procedures for the effective management of the supply chain.

Key Deliverables

Assessment report and Recommendations: detailed report on the assessment indicating thorough analysis of current systems and practices, and practical recommendations on what needs to be improved/ implemented. Develop prequalification, shortlisting and preferred suppliers template. Supplier pre-qualifications list: establish list of quality service providers/vendors for specific categories of goods and services. Revised and aligned SCM structure and job specifications.Develop SCM key performance indicators for each of the main areas.Reporting Arrangements

The Consultant will report to the Regional Head of Support Services (RHSS).

Monthly work plans Bi-weekly updates and status report to the RHSS. Final report and deliverables at the end of the assignment.The Consultant will be based in Nairobi with travel to Somalia.

Requirements:

The Consultant must meet the following minimum requirements:

Introduction

Save the Children has been working in Kenya since 1984. Current programmes focus on Child Protection, Child Rights Governance, Education, Health, HIV/AIDS, Livelihood, Nutrition and WASH implementing both directly and through local partners. Save the Children has child protection intervention in Dadaab Refugee Camps and works with partners on child protection issues at the national and local level.

The programme in the Dadaab Refugee Camps is one of the largest child protection programmes of Save the Children globally. 

A system approach is used to strengthen the child protection mechanisms at multi-levels targeting government and non-government actors, the community and children themselves. A comprehensive case management system is established to respond to the gravest child protection violations in the camps through identification, assessment, Best Interest Determination, referral and follow-up visits. Community-based alternative care, child protection community structures, child participation and psychosocial support, as well as community sensitisation and advocacy for behaviour changes are also key components of the programme.  Currently the Dadaab programme is funded by UNHCR, UNICEF, BPRM and private donors, and is under-going a comprehensive review and evaluation of services over the past 6 years.

Save the Children also works with partners at the national level and within other projects to ensure that Children without Appropriate Care receive protective services, that working children’s needs are addressed and that children who have been abused are supported with comprehensive services.  

We seek to expand this work in the coming six months.  We also would like to build on several studies and publications that Save the Children has worked on – including issues of children connected to the streets in the Rift Valley, children in urban slums in Mombasa and sexual violence in conflict.

Job Purpose

The Child Protection Technical Consultant will be under the functional and technical supervision of the Director of Programme Development and Quality in Nairobi. 

The Consultant will provide technical expertise to Save the Children’s Child Protection programme in the following key areas:

Support the development and capacity building of the child protection staff in Dadaab to assume senior roles in managing the large-scale programme.  One staff will be mentored to take on the CP Manager role.  This will also include assisting the projects to transition to a more community-managed strategy (internally known as “Desert Flower”).  The consultant will ensure that a pilot in one camp is documented and staff are prepared to replicate lessons learned in other camps.Ensure the planned evaluation of the comprehensive Child Protection system in Dadaab refugee camp is completed and that data from the field and report drafts are adequately reviewed and prepared for sharing. A second external consultant has been identified and secured who will lead this evaluation.Oversee the subsequent documentation of the comprehensive Child Protection system in Dadaab refugee camp for communications and fundraising purposes.Represent Save the Children at the national level with UNICEF, UNHCR, the Government of Kenya and other donors and partners, as requested.Support the country office to remain a key contributor to national-level coordination on child protection; link field programmes with relevant structures and developments in the child protection systems; and ensure the delivery of programme quality is in line with donors’ requirements and child protection minimum standards.   Key Deliverables

The Child Protection Advisor will be based in Nairobi with travel to field sites within Kenya as required.

1. Mentoring and transition plan for Dadaab 

Work closely with the existing team in Dadaab to transition child protection staff to more senior roles and prepare for management with appropriate tools and systems.  This will include working on M&E systems to coordinate supervisory feedback and track progress.  One key deliverable is an agreed upon mentoring plan for the new Child Protection Manager.  Assist staff in Dadaab in designing and documenting the transition strategy from the current direct service delivery to the new Desert Flower approach, which includes more community engagement and ownership of services at the child friendly centres.  The deliverable is a documented step-by-step plan of how to move to the Desert Flower approach, with key lessons from one pilot in a selected camp.2. Fundraising and proposal developmentSupport the development of child protection proposals/concept notes for Dadaab and the emergency portfolio: ensure coordinated input from the field teams and other departments in the Nairobi office.3. External networking and representationEstablish new contacts and maintain existing relationships with key national level and field level donorsSupport the Department of Children’s Service to lead the Child Protection Working Group in Nairobi alongside with UNICEF. Ensure participation and representation of SC in other key coordination meetings at the national level Actively participate in key relevant internal meetings such as Programme Review, coordination meetings or area-based meetings as required.  Participate in Donor visits to project(s) within the child protection portfolio as required.  4. Recruitment of a full-time Child Protection Advisor for the Kenya country officeAssist in the recruitment and training of a full-time Child Protection Advisor for the Kenya country office.5. Provide technical back-stopping for the country office in Child ProtectionOn a day-to-day basis provide technical back-stopping and representation for Save the Children at the national level.  Coordinate with Technical Advisors from the regional office and Save the Children Members to ensure that our projects are delivering according to donor expectations, and community needs.  Provide technical review of donor reports prior to submission.Ensure that programme quality issues are raised within the Programme Development and Quality team, especially in regards to field-level implementation.Masters degree required in relevant field, social work background highly desired.5 years field-based technical experience in child protection programmes in development and humanitarian settings. Experience working in Dadaab or other refugee settings will be an asset.Experience in national-level coordination and representation, including translating field-level challenges to donors and national and global debates and policy and best practice developments to field teams.Experience in case management, working with child survivors of SGBV and CAAFAG.Proven capacity to design, implement and evaluate protection programmes with children, youth, and families in difficult circumstances.Extensive experience in programme design, proposal development, and reporting for bilateral donors and private foundations.
